The Supreme Court made a big decision today regarding the government’s change to Article 370 in 2019. This change removed the special status that Jammu and Kashmir used to have. The court, led by Chief Justice DY Chandrachud, declared that the move to abrogate Article 370 was valid.
The court had been looking into 23 different petitions about this matter since September 5. After 16 days of hearings, they finally made a decision. The bench, including other Justices like S K Kaul, Sanjeev Khanna, B R Gavai, and Surya Kant, concluded that Jammu and Kashmir didn’t have internal sovereignty after joining India. The court didn’t find any clear evidence that the President’s orders in 2019 were wrongly motivated or an abuse of power.
CJI DY Chandrachud pointed out that the reorganization of Jammu and Kashmir into Union Territories in 2019 was meant to be a temporary arrangement. However, the court directed the government to restore statehood and organize Legislative Assembly elections.
Justice Kaul, in his supporting opinion, suggested the creation of a Truth and Reconciliation Commission specifically for Jammu and Kashmir. This commission would be tasked with acknowledging any alleged violations committed by the State and its actors in the region.
