In a significant move, Chief Minister Pushkar Singh Dhami of Uttarakhand presented the Common Civil Code (UCC) bill in the state Assembly on Tuesday. The bill covers various aspects such as marriage, divorce, succession, and live-in relationships among others. After the tabling of the bill, the Assembly was adjourned for further deliberation.
Key Provisions of the CCC Bill
The Common Civil Code Bill proposes several important measures. One notable provision is the requirement for live-in relationships to be registered under the law within one month of commencement. Adults entering into such relationships will need to obtain consent from their parents. Additionally, the bill enforces a complete ban on child marriage and introduces a uniform process for divorce. It also ensures equal rights to women from all religious backgrounds regarding ancestral property.
Age and Registration Requirements
Under the CCC Bill, the minimum age for marriage is set at 18 for women and 21 for men across all communities. Marriage registration becomes mandatory for all religions, and marriages conducted without registration will be deemed invalid. Moreover, the bill stipulates that no divorce petition can be filed within the first year of marriage.
Marriage Ceremonies and Exceptions
The proposed bill recognizes various marriage ceremonies, including those conducted under religious customs and acts such as “Saptapadt,” “Ashirvad,” “Nikah,” “Holy Union,” and “Anand Karaj.” However, it clarifies that the provisions of the bill will not apply to members of Scheduled Tribes or those protected under Part XXI of the Indian Constitution.
CM Dhami’s Vision
Chief Minister Dhami emphasized that the passage of the CCC Bill aligns with Prime Minister Narendra Modi’s vision of “One India, Best India.” He expressed confidence that Uttarakhand would emerge as a strong supporter of this vision. Dhami underscored the government’s commitment to representing all sections of society while presenting the bill in the Assembly.
Fulfillment of BJP’s Promise
The introduction of the CCC Bill fulfills a significant promise made by the Bharatiya Janata Party (BJP) to the people of Uttarakhand during the 2022 Assembly elections. In March 2022, the Dhami government initiated the process by forming a committee to draft the bill.
