The Supreme Court Bar Association has written to President Droupadi Murmu seeking a Presidential Reference in the Electoral Bonds case.
The SCBA’s President Adish Aggarwala in a letter to Murmu said that the Supreme Court should not deliver judgments that create constitutional stalemate and undermine the majesty of the Parliament.
Aggarwala has asked that the entire proceedings be reheard, so that complete justice can be ensured to the Parliament of India, political parties, corporates, and the general public.
The Supreme Court through its February 14 had struck down the concept of electoral bonds in its current form unconstitutional. The SC claimed that the poll bond scheme infringes upon the Right to Information of the Bharatiya voter by anonymizing the contributions, being violative of Article 19(1)(a) of the Constitution.
The Supreme Court’s five-judge constitution bench headed by Chief Justice DY Chandrachud on Monday dismissed the State Bank Of India’s plea seeking an extension of time till June 30 to close the details of donors.
Further, it asked the Election Commission of India to publish the information shared by the bank on its official website by 5 pm on March 15.
