Delhi High Court to Deliver Verdict on Arvind Kejriwal’s Plea Against ED Arrest

The Delhi High Court is set to announce its verdict on Tuesday, April 9, regarding the petition filed by Delhi Chief Minister Arvind Kejriwal challenging his arrest by the Enforcement Directorate (ED) in connection with the Delhi excise policy case.

Justice Swarana Kanta Sharma is scheduled to deliver the verdict on Kejriwal’s petition at 2:30 pm on Tuesday, April 9. Kejriwal filed a petition in the Delhi High Court challenging both his arrest in the money laundering case related to the Delhi excise policy and his subsequent remand in ED custody.

The last hearing at the Delhi High Court occurred on April 3, during which Arvind Kejriwal questioned the timing of his arrest, particularly in light of the upcoming Lok Sabha elections. Kejriwal argued that his arrest violated the fundamental principles of the Constitution, while the ED contended that the law applies equally to him as to any other citizen, labeling him as the key figure in the Delhi excise policy case.

Despite the ED’s claims of establishing a money trail connecting the Chief Minister to the case, Arvind Kejriwal maintains his innocence, citing a lack of concrete evidence linking him to the alleged scam.

The initial hearing on the Chief Minister’s petition occurred on March 27, with Justice Sharma listing the matter for final disposal on April 3. Following extensive arguments from both sides, the high court reserved its verdict.

Senior advocate Abhishek Manu Singhvi, representing Arvind Kejriwal, argued that the arrest was a strategic move by the Centre to thwart his political involvement, deemed unconstitutional.

Additional Solicitor General SV Raju, representing the Enforcement Directorate, countered that individuals, regardless of their positions, cannot evade legal repercussions for alleged crimes, denouncing the claim of immunity due to political stature.

Arvind Kejriwal, arrested by the Enforcement Directorate on March 21, was previously remanded to judicial custody until April 15 during the last hearing. He is currently detained at Delhi’s Tihar Jail.
