Delhi’s Tis Hazari Court has denied bail to Bibhav Kumar, an aide of Delhi Chief Minister Arvind Kejriwal, in the alleged assault case involving Swati Maliwal.

Kumar’s bail application was dismissed on Monday following his arrest by the Delhi Police based on an FIR filed by Maliwal, accusing him of assaulting her at Kejriwal’s residence on May 13. This decision comes amidst a heated legal battle between the two parties.

Maliwal, who was present during the court hearing, reportedly broke down while the defence counsel presented arguments. She expressed concerns about a “huge troll machinery” allegedly backing Kumar and emphasized the threat she perceives to herself and her family if he were to be released on bail.

Maliwal, recently elected to the Rajya Sabha, argued that Kumar, despite being an aide, enjoys privileges akin to those of ministers, posing a potential risk.

During the proceedings, Kumar’s counsel, N Hariharan, countered Maliwal’s claims by stating that she arrived at Kejriwal’s residence without prior permission or appointment. He highlighted a reported trespass incident and asserted that Maliwal was stopped by security personnel before confronting them about her status as an MP.

Hariharan emphasized that there was no prior communication regarding Maliwal’s visit, questioning her entitlement to entry into the official residence of the Chief Minister.

Maliwal’s allegations revolve around an alleged assault by Kumar when she visited Kejriwal’s residence. She accuses Kumar of physically attacking her during the encounter. However, Kumar’s legal team argues that Maliwal’s unannounced visit and subsequent confrontation with security personnel constitute trespassing, casting doubt on the validity of her claims.

With Kumar’s bail plea rejected, the case is likely to proceed to trial, where both parties will present evidence and arguments to support their respective claims. The court’s decision underscores the seriousness of the allegations and the need for a thorough legal examination of the incident.

As the legal battle continues, the outcome will not only impact the individuals involved but also raise questions about the security protocols at the residences of public officials.
