Delhi High Court Upholds Arrest of Bibhav Kumar in Swati Maliwal Assault Case; Supreme Court Criticizes Kejriwal's Aide

In a recent ruling, the Delhi High Court has upheld the arrest of Bibhav Kumar, a close aide to Chief Minister Arvind Kejriwal, rejecting his plea that claimed his arrest was illegal. This decision came during a hearing on Friday, 2 August, presided over by Justice Neena Bansal Krishna.

Kumar had been arrested by the Delhi Police on 18 May in connection with the assault case of Aam Aadmi Party (AAP) Rajya Sabha MP Swati Maliwal. He challenged the legality of his arrest and sought compensation, but his plea was denied by the High Court.

This is not the first time Kumar has faced setbacks in court. Previously, the Delhi High Court had also rejected his bail plea. Following that decision, he approached the Supreme Court, which has now issued a notice against him. Additionally, the trial court has twice denied him bail, further complicating his legal battles.

The Delhi Police have accused Kumar of being uncooperative throughout their investigation. They allege that he provided evasive responses and refused to disclose the password to his mobile phone, which they consider crucial for uncovering the truth in the probe.

The Supreme Court has also criticized Kumar’s behavior. The court remarked harshly on his actions, suggesting that he behaved like a goon at the Chief Minister’s official residence. This comment reflects the seriousness with which the court views the allegations against him.

The incident in question occurred on 13 May at the official residence of the Delhi Chief Minister when Kejriwal was out on bail. Swati Maliwal accused Kumar of assaulting her, stating that he kicked her in the chest, stomach, and pelvic area, and then brutally dragged her. An FIR was registered against Kumar on 16 May, leading to his arrest.

The charges against Kumar include criminal intimidation, assault or criminal force on a woman with the intent to disrobe, and an attempt to commit culpable homicide. These are serious accusations that carry significant legal consequences.

Chief Minister Kejriwal, who initially remained silent on the matter, later called for a fair investigation into the incident. His statement came amidst growing public and political pressure for transparency and accountability in handling the case involving his close aide.

As the legal proceedings continue, the case remains a significant issue for the Aam Aadmi Party and its leadership, highlighting the challenges and controversies that can arise within political circles.
