In a hearing of the RG Kar incident, the Supreme Court formed a national taskforce to ensure the safety of doctors in the country.
They announced the following members of the task force: Surgeon Vice Admiral RK Sarian; Dr Reddy, Managing Director Asian Institute of National Gastrology; Dr M Srivas, Director AIIMS, Delhi; Dr Prathima Moorthy, NIMHANS, Bangalore; Dr Puri, Director, AIIMs, Jodhpur; Dr Ravat, Managing member of Gangaram Hospital; Prof Anita Saxena, VC of Pandit BD Sharma College; Dr Pallavi and Dr Padma Srivastav.
The taskforce will also include ex-officio members – the cabinet secretary, the home secretary, secretary of ministry of family welfare, chairperson of the National Medical commission and (e) President of the National Board of Examiners.
The Supreme Court has overturned the decision of the Calcutta High Court which remarked that “minor girls should control their sexual desires instead of two minutes of fun”. The Supreme Court has also upheld the punishment given to the convict for rape.
The West Bengal government had filed a petition in the Supreme Court against the decision of the Calcutta High Court. The Supreme Court also took suo motu cognizance of the matter.
During the hearing on December 8, 2023, the Supreme Court had asked the lawyer of the West Bengal government about his stand on filing an appeal in this matter. The court had said that judges should not express their personal opinion in such cases. Justice AS Oka had asked the West Bengal government to tell whether it has challenged or wants to challenge this decision of the Calcutta High Court.
The Supreme Court had issued notice to the accused and the victim in this case. The Supreme Court said that judges should avoid preaching. The Supreme Court had called the High Court’s remarks unnecessary and objectionable.
It is noteworthy that on October 18, 2023, while hearing a POCSO case, the division bench of the Calcutta High Court had remarked that “minor girls should control their sexual desires instead of two minutes of fun.”
