SC Rules No Survey of Idgah in Mathura Janmabhoomi Case, Interim Orders to Continue

In a recent development concerning the Gyanvapi case, the Supreme Court has decided to prolong the stay on the Allahabad High Court’s order that appointed a Commission for the Shahi Eidgah Mosque. This decision is related to the ongoing Mathura Sri Krishna Janmabhoomi-Shahi Idgah Masjid dispute. The extension will remain in effect until the next scheduled hearing.

Mathura Dispute Stay Extension: The Supreme Court’s decision to extend the stay on the Commission’s appointment comes as part of the ongoing legal proceedings related to the Mathura Janmabhoomi-Shahi Idgah Masjid dispute. The court is set to reconvene for the next hearing, and until then, the stay remains in place.

Application to Revive ‘Shivling’ Survey: In a parallel development, a Hindu plaintiff has filed an application urging the Supreme Court to revoke its May 19, 2023, order temporarily suspending the scientific survey of a ‘Shivling’ reportedly discovered within the Gyanvapi mosque complex in Varanasi. The applicant specifically requests the court to direct the Archaeological Survey of India (ASI) to conduct a thorough investigation and survey of the alleged “Shivling” without causing any harm to the sacred structure.

Nature of ‘Shivling’ Investigation: The proposed survey involves the removal of artificial and modern walls/floors surrounding the ‘Shivling.’ The aim is to determine its nature and associated features through a comprehensive examination of the entire sealed area using excavation and other scientific methods. The applicant emphasizes the need for a detailed report to be submitted afterward.

Adjournment and Instructions: The Supreme Court has adjourned the hearing on these matters until April. In the interim, the court has instructed all involved parties to complete their pleadings and submit written submissions before the rescheduled hearing date. This move suggests a commitment to a thorough and well-informed deliberation on the complex issues surrounding the Gyanvapi case and the Mathura Janmabhoomi-Shahi Idgah Masjid dispute.
