In a recent development, the Directorate of Enforcement (ED) acknowledged an inadvertent error in the appearance of Advocate Bansuri Swaraj in the Delhi Liquor Policy case. This error was brought to light during proceedings before the Supreme Court, where ED counsel Zoheb Hossain clarified that Bansuri Swaraj had not been engaged nor did she appear on behalf of the agency in the matter.
The issue was raised before a Bench led by Justice Sanjiv Khanna, alongside Justices MM Sundresh and Bela M Trivedi. It was noted that Advocate Bansuri Swaraj’s name had appeared in the order granting bail to Aam Aadmi Party (AAP) MP Sanjay Singh in the said case, despite her lack of involvement.
Hossain emphasized that the error seemed to have occurred due to a mechanical oversight, possibly in the central agency’s process of assigning advocate names. He requested the court to rectify the appearance record accordingly.
Responding to the ED’s acknowledgment, Justice Khanna assured that the necessary corrections would be made to address the error. This acknowledgment comes in the wake of the bail granted to Sanjay Singh on the basis of the ED’s concession, considering the peculiar circumstances of the case.
Earlier in the day, AAP leader Saurabh Bhardwaj took to social media platform ‘X’ to share a screenshot of the order, highlighting Bansuri Swaraj’s name. Bhardwaj alleged that this error indicated collusion between the Bharatiya Janata Party (BJP) and the ED, implying bias in the legal proceedings.
However, with the ED promptly acknowledging and rectifying the error, it underscores the importance of transparency and accuracy in legal proceedings. The correction serves to uphold the integrity of the judicial process and ensures fair representation for all parties involved.
