On Thursday the Supreme Court held that the sub-classification of Scheduled Castes (SC) and Scheduled Tribes(ST) was allowed to grant separate quotas for the more marginalised among backward communities. In a majority verdict, the top court entitled the states with power to make sub-classifications of SC and STs for granting quotas inside the reserved category to uplift more underprivileged castes.
A 7-judge bench of the Supreme Court, led by CJI DY Chandrachud overruled the 2005 judgment of the apex court which had ruled that state governments had no power to create sub-categories of SCs for the purpose of reservation. While passing the order, CJI Chandrachud said there were six opinions as the bench delivered six separate judgments.. Meanwhile, Justice Bela Trivedi dissented.
The majority verdict said the basis of sub-classification has to be justified by quantifiable and demonstrable data by the states, which cannot act on its whims. The CJI said, ‘Majority of us have overruled EV Chinnaiah and we hold sub classification is permitted’.
‘I want to thank you for your time, seeing me this afternoon. I want to thank you for your efforts in arranging my visit to India with such short notice and a very tight schedule. I would like to thank the two foreign ministries for making the best preparations for this visit’, said Pham Minh Chinh.
Further, Chinh also congratulated Prime Minister Narendra Modi for his win in the third consecutive term and termed this a historic victory.
