On Monday, the Supreme Court made a decision that came up as a major setback to the Aam Aadmi Party. The Supreme Court made a decision that Delhi LG Vinai Kumar Saxena can independently nominate the 10 Alderman in the Municipal Corporation of Delhi (MCD).
The apex court in its order said that LG’s decision to nominate 10 ‘aldermen’ in the Municipal Corporation of Delhi does not need aid and advice of the council of ministers.
It further added that LG’s power to nominate members to the MCD is a statutory power and not an executive power. A Supreme Court bench led by Chief Justice of India (CJI) D Y Chandrachud rejected the Delhi government’s plea that the LG is bound to act on the aid and advice of council of ministers in nominating 10 MCD.
The bench also comprised Justices P S Narasimha and J B Pardiwala. The top court delivered its verdict on the Delhi government’s plea after reserving it for nearly 15 months.
Earlier on May 17 last year, the SC had said that giving the LG the responsibility to nominate the MCD aldermen would mean that he could destabilise an elected civic body.
The MCD has 250 elected and 10 nominated members. In December 2022, the AAP defeated the BJP in the MCD polls, putting an end to 15-year-old of the saffon party. The AAP claimed 134 seats, while the BJP secured 104 and the Congress nine.
