The Allahabad High Court on Wednesday pronounced its verdict on the recall petition of the Muslim side in the Sri Krishna Janmabhoomi and Shahi Idgah Mosque dispute case of Mathura and rejected the petition of the Muslim side.
The recall petition was filed by the Shahi Idgah side seeking withdrawal of the High Court order of 11 January 2024 to hear 18 cases filed together on 16 October in this case. After the completion of its debate, the bench of Justice Mayank Kumar Jain reserved the order. The Muslim side had filed a recall petition seeking withdrawal of the order of 11 January 2024.
A single bench of Justice Mayank Kumar Jain is hearing this. Both the parties had presented their side in the court on 16 October. The Muslim side had said that the reliefs sought in all the cases are different and unequal. It is not right to hear them together. Along with this, a prayer was made to the court to accept the recall application. At the same time, a written objection was filed on behalf of Ashutosh Pandey, President of Shri Krishna Janmabhoomi Mukti Nirman Trust. All others had objected in the oral debate and opposed the recall application of the Muslim side.
On January 11, 2024, the High Court had ordered to hear all the 18 cases filed in this case together. After this, the High Court, while giving its verdict on August 1, 2024, approved the 18 petitions of the Hindu side for hearing, rejected the objection of the mosque side and ordered to present the side before the trial began. The Allahabad High Court is hearing 18 civil cases filed by the Hindu side. Before the trial began, the Muslim side had filed a recall petition, demanding withdrawal of the order passed on January 11, 2024 and first hearing on the recall petition. Which was rejected again by the High Court today.
