Delhi, 27 January (H.S.) : The Jharkhand government has got a setback from the Supreme Court. A bench headed by Justice AS Oka dismissed the state government’s petition against the Jharkhand High Court’s decision, which quashed the FIR registered against 28 BJP leaders including BJP MP Nishikant Dubey and Babulal Marandi for a protest in 2023. Justice AS Oka ordered the dismissal of the Jharkhand government’s petition.
During the hearing, the Supreme Court questioned the repeated imposition of Section 144 to stop demonstrations across the country. The court said that this trend is not right to impose Section 144 to stop people’s demonstrations. This gives a bad signal. If someone wants to protest, then what is the need to impose Section 144. By doing this, Section 144 is being misused.
An FIR was registered against BJP leaders for rioting in 2023. The FIR said that despite the imposition of Section 144, a demonstration was held with the aim of spreading riots. According to Jharkhand Police, the protesters started breaking barricades and throwing stones and bottles during the demonstration. The Jharkhand High Court quashed the FIR registered against Nishikant Dubey and other accused in August 2024.
