‘He deserves to be thrown out’: SC Upholds Dismissal of Lt. Samuel Kamalesan for Refusing To Enter Gurudwara During Regimental Parade
The Supreme Court has upheld the dismissal of Lieutenant Samuel Kamalesan, a Christian officer, who declined to enter a Gurudwara during a regimental parade. Kamalesan argued that his refusal was based on personal religious beliefs and that he had otherwise participated in multi-faith activities. His lawyer maintained that the act was not repeated and should not have led to such a severe penalty.
The bench, headed by Chief Justice Surya Kant, disagreed, stating that the Armed Forces function on strict discipline, and individual religious preferences cannot undermine collective duty. The Court highlighted that a local pastor had clarified that entering another religion’s worship place does not violate Christian teachings. The judges noted that an officer must set an example for troops, and such behaviour affects morale. The plea for leniency was rejected, with the Court stressing that unity and discipline are non-negotiable in the Army.

Chief Justice of India Surya Kant has introduced a stricter system for taking up urgent matters in the Supreme Court. His remarks came after a lawyer sought urgent intervention in a case involving the demolition of a canteen before a bench of CJI Surya Kant and Justices Joymalya Baghchi and A.S. Chandurkar. The CJI firmly stated that only matters involving extreme situations such as personal liberty or death penalty concerns would be considered directly in court. All other requests must go through the written process.
