Emphasising the gravity of the situation, the ASG highlighted that intellectuals turning extremist pose the highest threat.
He said: “Intellectuals who got degrees with state support, who used state funding to become doctors, and then use it for nefarious activities, they are much more dangerous.”
V. Raju also stated that any delay in trial proceedings was caused by the accused themselves. He pointed out that Sharjeel described the movement not as a protest but as a “violent protest,” called for Assam’s separation, mentioned the strategic “chicken neck” corridor, discussed Kashmir, criticised the court, and referenced Babri Masjid, all indicating an intention to destabilize the government.

Can’t Impose Timelines On Governors, President To Give Assent: Supreme Court Rejects Concept of “Deemed Assent” In Presidential Reference
In a landmark ruling the Supreme Court of India has held that it can’t impose a timeline on Governors or the President to grant assent to bills under Articles 200/201 of the Constitution.
The Court has dismissed the concept of “deemed assent” in case a bill is kept pending beyond a certain period noting that such a doctrine was antithetical to the spirit of the Constitution and against the doctrine of separation of powers. The 5-judge bench asserted that the concept of Courts declaring “deemed assent” is virtually a take over of the functions reserved for the Governor.
The Court held, “We have no hesitation in concluding that deemed consent of the Governor, or President, under Article 200 or 201 at the expiry of a judicially set timeline, is virtually a takeover, and substitution, of the executive functions by the Judiciary, through judicial pronouncement, which is impermissible within the contours of our written Constitution.”
However, prolonged inaction or delay by Governors can be subject to “limited judicial review”, with courts empowered to direct decision-making within a reasonable period.
Withholding assent by the Governor must be accompanied by returning the Bill to the Assembly – the Governor cannot indefinitely withhold without communication.
The bench led by CJI BR Gavai, with Justices Surya Kant, Vikram Nath, PS Narasimha, and AS Chandurkar, issued the opinion on Presidential reference. It heard the matter for ten days and reserved its opinion on 11th September.
President Droupadi Murmu had sought the Presidential reference in May, soon after the 2-judge bench delivered judgement in the Tamil Nadu Governor case, which laid down timelines for the President and the Governor to act on Bills.
The President is not bound to seek Supreme Court opinion when a Bill is reserved by the Governor for presidential assent.
